We are aware that there is not any legislation or regulation specifically requiring Local Authorities to hold and manage information on child abuse perpetrators. However there are local policies and procedures in place, as outlined in the Pan Sussex Safeguarding & Child Protection procedures (Section 9. Risk Management of Known Offenders and Those Who Pose a Risk) that provides a clear framework for safeguarding practice around this issue.

There is no individual responsible for deciding which information is collected in these areas. The information is collected with regards the Local Authorities role in safeguarding children and will be relevant with regards children suffering disadvantage as a result of these factors within our services.

The Pan Sussex Safeguarding and Child Protection Procedures are the child protection policies and procedures followed by Brighton & Hove Children’s Services. These are joint procedures which have been compiled and updated by the Brighton & Hove Local Safeguarding Children’s Board (LSCB), East Sussex LSCB and West Sussex LSCB.

I have spoken to FOI colleagues who advise that LSCBs do not fall into the legal definition of Public Authorities. If you would like more information on what constitutes a Public Authority for the purposes of FOI I’ve enclosed the link to the Information Commissioner’s Guidance

I wonder if the LSCB annual report might help you with your query. This can be found on our website at LSCB Annual Report 12-13

In answer to your question about how a member of the public can hold the LSCB to account, this can be done through your local councillors and ultimately the Lead Member.

The LSCB has no statutory basis and is not classed as a public authority for the purpose of the Freedom of Information Act. The LSCB is a group set up under guidance under ‘Working Together’ made up of various agencies involved with the protection of children. Therefore we are not in a position to respond to your request. However, looking at information you have requested I think the FOI team at Brighton and Hove Council may be able to assist you further.

This request would require individual manual interrogation of some 376 records and the time taken would exceed the guidelines set out under FOIA. It is therefore Exempt under S.12 of the Freedom of Information Act. In order to assist we have provided a link to the Characteristics of children in need in England: 2012 to 2013. If the requestor downloads the spreadsheet under SFR45/2013: Main tables provides, Table D2 provides the number of children who became the subject of a child protection plan during the year ending 31 March 2013, by initial and latest category of abuse. This will not identify the gender and familial relationship of the offender which could only be identified by interrogating each file.
