Dear David Davis,

The Great Repeal Bill ends the presumption of innocence by converting the ‘acquis’ – the body of existing EU law into British law. What this means for a person who is accused of a criminal offence is they will be required by the state to prove their innocence instead of the state having to prove a person is guilty of a criminal offence in a court of law beyond a reasonable doubt. The public are treated completely differently by these two completely opposing legal systems. 52% of the British public voted to leave the EU & instead of repealing the European Communities Act 1972 which is the legislation which underpins the UK’s EU membership the Government decided to trigger Article 50 instead which lets the EU dictate our leaving terms.

Dear Mr Mortimer,

Thank you for writing to the Department for Exiting the EU. We are responding on behalf of the Secretary of State and apologise for the delay.

The Great Repeal Bill will end the authority of EU law in the UK, and return powers from Brussels to the UK. Acts of Parliament that are passed after we have left the EU will take precedence over the former EU law which we have converted into UK law.

The White Paper sets out the detail of our approach to the Great Repeal Bill and how the domestic legal system will work once we have left the EU. The White Paper is the start of an open discussion with Parliament on the programme of legislation for exit. Parliament will continue to have its say throughout the process of negotiation, with extensive scrutiny and debate, including on the Great Repeal Bill.

The Bill aims to maximise certainty for individuals and businesses as we leave the EU. It is in no one’s interests for there to be a cliff edge when we leave the EU, and so the laws and rules that we have now will, wherever practicable, continue to apply. This gives the maximum possible certainty to individuals and businesses about their legal rights and obligations as we leave the EU, and provides the basis for a smooth and orderly exit.
